As a rule, a foreigner who wants to work in Poland should have a work permit. Of course, there are exceptions to this, but regardless of the choice of employment path for foreign workers, it involves additional obligations. Recently, the website of the Government Legislation Center published a draft amending the regulation of the Minister of Labor and Social Policy on cases in which entrusting work to a foreigner in the territory of the Republic of Poland is permissible without the need to obtain a work permit.

The change specified in the draft indicates that a foreigner may undertake work without a permit if he or she has a special visa, which was issued "for the purpose of coming for humanitarian reasons, due to the interest of the state or international obligations". Such visas will have a special note "Poland Business Harbor".

Poland Business Harbor is the name of a new government project addressed to the citizens of Belarus. On the website www.gov.pl you can read about the program:

“A comprehensive package that helps IT specialists, start-ups and other companies to relocate seamlessly to the territory of the Republic of Poland. Thanks to the package of services, you will be able to find out, among others how to quickly and efficiently start operating in Poland, obtain support in the relocation of employees and their families or receive legal and visa assistance in the "business concierge" formula. In addition, natural persons and companies from Belarus can count on facilitating contact with local governments or Special Economic Zones, which actively participated in the preparation of an offer for relocated employees and their families, creating temporary office and residential space. Additionally, children who continue their education in Polish schools will be entitled to additional hours of learning Polish. One of the elements of the package is also support in the form of connecting entrepreneurs with investors and grants for R&D activity ”.

Currently, the program is aimed at citizens of Belarus, but it is not ruled out that it will also expand to other countries in the future.

The justification for the project indicated that the reason was the need for Poland to increase the number of specialists in the IT industry, because there are large amounts of them in the country.

Work for foreigners without a permit - also for medics

The draft also provides for an exemption from having a work permit for doctors and dentists. Importantly, medics "both those with unlimited and limited right to practice their profession" will be able to take advantage of this. The proposed regulations are of course related to the current situation of the coronavirus pandemic and the huge shortages in the medical staff. However, it was underlined that the provisions would also apply after the end of the pandemic period. This is to be one of the ways to fill the staff shortages among doctors, and this process in Poland should be long-term and structural.

Work for foreigners without a permit is also to cover foreigners employed in private domestic service by diplomatic representatives.
