Sickness benefit is a benefit paid by ZUS for the period of inability to work due to illness. The mandate contract and the sickness benefit is a slightly more extensive topic. In order for the contractor to receive the service, it must meet certain conditions. So when is Contractor Benefit paid out? What documents should be submitted to ZUS to receive it? Can you count on funds also after the termination of the contract? You will find the answer below.

Contract of mandate and sickness benefit

Every person covered by sickness insurance is entitled to sickness benefit. At the same time, it does not matter whether the subordination under insurance is compulsory or voluntary. This means that also persons performing work under a mandate contract can count on such a benefit.

If the contractor wants to join the sickness insurance, he must complete a written application and then submit it to the client. Then the ordering party is obliged to register the employee with ZUS

Persons who:
- are students under the age of 26 - such people are not reported to the Social Insurance Institution, because they are covered by insurance for education,
- they are subject to social insurance (retirement and disability pension) voluntarily - you can join sickness insurance only if these contributions are obligatorily paid.

Contract of mandate and sickness benefit - waiting period

In the case of a mandate contract, the employee acquires the right to sickness benefit after 90 days of an uninterrupted insurance period. The above-mentioned 90 days include previous insurance periods, if the break between them was not more than 30 days or was caused by a parental leave, unpaid leave or active military service by a lay soldier.

The waiting period does not apply to the maternity or care allowance - they are due from the first day of insurance coverage.

The right to sickness benefit from the first day of insurance

It is also worth knowing that it is possible to get sickness benefit from the first day of insurance. This benefit is granted to:

  • school graduates who were covered by sickness insurance or joined sickness insurance within 90 days of graduating from school,
  • persons whose incapacity for work was caused by an accident on the way to or from work,
  • obligatorily insured persons who have had an earlier, at least ten-year period of compulsory sickness insurance,
  • deputies and senators who joined sickness insurance within 90 days from the end of their term of office.

Documents to be submitted to ZUS in order to pay the allowance for the contractor

If the ordering party is not a benefit payer, then he is obliged to submit to ZUS:

  • a completed ZUS Z-3a form, which shows the income achieved by the employee, which is the basis for calculating the sickness contribution.

The contractor is entitled to the allowance from the first day of illness. The client does not pay sick pay for the first 33 or 14 days of leave, as is the case with an employment relationship.

Demonstration of the contractor's illness in the ZUS declaration

The benefit for the contractor should be included in the ZUS declaration. If the contractor is sick for the whole month, then it is shown only on the RSA declaration with the insurance title code 04 11 xx and the break benefit code 313. On the other hand, if the employee is sick only for part of the month, and the remuneration for the rest of the month is paid, it is shown. on two reports:

  • RCA with the insurance title code 04 11 xx and the salary constituting the basis for the calculation of social and health contributions,
  • RSA with insurance title code 04 11 xx, break benefit code 313 and the period of sick leave.

Contract of mandate and the amount of sickness benefit

Employees are entitled to sickness benefit in the amount of 80% of the monthly allowance calculation basis, and 70% of the allowance calculation basis for the period of hospital stay. A monthly allowance in the amount of 100% of the allowance calculation basis is possible if the incapacity for work occurred during pregnancy, as a result of undergoing the necessary medical examinations provided for candidates for donors of cells, tissues and organs or undergoing the procedure of cell, tissue and organ donation and in if it was caused by an accident on the way to or from work.

End of contract allowance

The contract of mandate and sickness benefit in terms of termination of the contract are also regulated. In this situation, the sickness allowance is also granted to a person who became incapable of work after the end of sickness insurance, if the incapacity lasted continuously for at least 30 days and arose no later than within:

  • 14 days from the end of sickness insurance,
  • 3 months from the end of sickness insurance in the case of an infectious disease, the incubation period of which exceeds 14 days, or another disease whose symptoms become apparent after a period of more than 14 days from the onset of the disease.

In summary, the contractor's sickness benefit is paid when he is entitled to sickness benefit. In turn, this may take place provided that the contractor has been registered for voluntary sickness insurance.
